Corporate Transparency Act

The Corporate Transparency Act is put on hold for now. A United States Federal Court in Texas enjoined the enforcement of the Act. Prior to this, I had clients and tax professionals reaching out for more information about what this Act meant, and who it applied to. The Corporate Transparency Act required that “beneficial owners” of US business entities file a form with the government prior to the beginning of next year. Essentially, it was a way for the United States government to know who really owned a business entity. Most of my clients with formal business entities never knew about this, and I had other clients worrying that this Act applied to them because they had a revocable living trust.

For now, there’s no rush to submit this form prior to the end of the year. Stay tuned, however, because the US government will likely appeal the Texas court’s ruling, and if that ruling is overturned, business entities will have to file this form.

COVID Stimulus Checks

Be aware that there are scammers claiming to work with the federal government needing your banking information so they can directly deposit your stimulus checks. It’s a scam! Don’t give out your banking information! The IRS will not contact you over the telephone asking for your bank account number or social security number.

When you sign important documents this year, be sure to sign the full year so the date isn’t easily altered. 6/2/20 can easily be turned into 6/2/2018 simply by adding digits behind the 20. Read more.

What kind of trust do you have?

Do you have an A-B Trust? Do you need an A-B Trust? Most of my clients have no idea what “type” of trust they have. Many of my clients have a trust that’s way too complex than necessary. We can simplify things and make them easy. Easy is usually a good thing. There are enough things to worry about- your trust shouldn’t be one of them.

Messy Wills

In most instances you would be better off executing a holographic will (a handwritten will- in YOUR own handwriting and signed by you) than you would using a kit will or one made up by an unqualified individual (ex. notary, paralegal). To make a valid will, there are some very specific things you must do- the laws are fairly specific in this area.

If you’re in California, I’ll give you a legal fill-in-the-blank will for free- just call.

I’d rather my clients, friends and fans have valid wills than leave behind a mess for their loved ones.
